Edmund Bon paid tribute to the late Ambassador Hla Myint of Myanmar, and highlighted how the unique nature and diverse membership of AICHR fosters new ways of doing things and are key elements of AICHR’s success in human rights diplomacy.
AICHR should conduct dialogues with relevant stakeholders as to post-conflict management, accountability and reconciliation in Myanmar, and any dialogue on the Five-Point Consensus needs to be conducted in a more inclusive and sustainable approach that will consider and realise the right to development of the affected people of Myanmar.
The ASEAN Human Rights Dialogue offers opportunities for Member States to be more transparent and frank in their discussions of human rights – as the key avenue for making stronger progress through normalizing talk of human rights and addressing issues.
While ESG is important, most of its measures are not couched in rights. Rights give rise to justiciable claims and empower victims and survivors to go to the courts. We need to take legal, policy, and administrative measures to incorporate human rights into our governance and laws. Human rights and environmental due diligence must be mandatory to protect vulnerable communities.
Edmund extended his appreciation to the team of experts and everyone who contributed to the drafting of the National Baseline Assessment on Business and Human Rights in Malaysia. The report presented important recommendations: to mainstream human rights, to make human rights and environmental due diligence mandatory, and to better protect marginalised communities.
Speaking on geopolitical and geoeconomic megatrends in ASEAN, Edmund Bon cautioned that, while the economic “decoupling” between the West and China may offer opportunities to ASEAN, human rights including labour rights, environmental rights, right to information, and right to self-determination need to be at the forefront of economic development in the region. Only then can we say we have achieved an ASEAN Centrality that can adequately safeguard our peoples.
Edmund Bon called on ASEAN’s foreign ministers and human rights experts to collectively rethink AICHR’s internal challenges and enhance AICHR’s institutional strength, by exploring new modalities that can effectively address regional human rights crises and make AICHR a force for change.
Malaysia has made strides in promoting and protecting human rights, including strengthening the Human Rights Commission of Malaysia (SUHAKAM), continued engagement with UN human rights mechanisms, ratification of ILO’s Occupational Safety and Health Convention 1981, and improvements in addressing human trafficking.
A noticeable shift is occurring in the assessment of corporate responsibility towards human rights, from voluntary initiatives and market-driven standards towards stricter regulatory requirements, including the growing utilisation of trade sanctions. At the 39th AICHR meeting in Jakarta on 21 May 2024, Edmund Bon outlined three key developments in Malaysia on refugee rights, the death penalty, and business and human rights.
Benchmark Litigation ranked AmerBON as “Highly Recommended” under the category of White Collar Crime, and “Notable” under Commercial and Transactions. One client’s feedback on AmerBON’s work: “Effective client management, strong commercial understanding of business partnerships, and a brilliant comprehension of how, why, and what to seek in a commercial arrangement to advise on litigation pressure points.”
This year, AmerBON was mentioned in two areas: dispute resolution, and real estate and construction. “The team was very prompt, responsive, responsible, and knowledgeable in the areas they were engaged to do. Queries and replies were promptly answered by the team and the answers given would always be comprehensive and to the point.”
Acting in civil litigation, corporate litigation, fraud, and human rights matters, a reviewer commented that Edmund is “shrewd, innovative, and knows the law well.”
While the AHRD has provided a platform for dialogue on human rights and has facilitated certain engagement initiatives, its limitations underscore ASEAN’s ongoing challenges in prioritising human rights. These shortcomings raise significant questions about the AHRD’s relevance and its overall impact within the ASEAN region.
Legislating for mandatory due diligence on human rights, labour, environmental, and governance matters is the right thing to do.
AmerBON warmly welcomes Shu Min to the team. Having worked with law enforcement agencies and as a prosecutor, Shu Min brings with her a unique skill set that includes policy development and law reform, as well as a passion for human rights.
Progress towards the Sustainable Development Goals (SDGs) has been slow. Growing income inequality, conflicts, and climate change pose significant challenges. One report says the SDGs can only be achieved in 2092. In this context, corporate accountability becomes crucial. The third pillar of the UNCPs — access to remedy — must be at the front and centre of our work on sustainability.
