Six sue cops and gov’t over human rights march

Malaysiakini | Amer Hamzah Arshad together with five human rights lawyers and activists filed a suit against the police and government, claiming that they were victims of malicious prosecution, and that the police acted in an oppressive, bothersome, intimidating, and frivolous manner, in breach of the constitution, the law, and procedures.

They arrested and charged founding LoyarBurokker, Amer Hamzah Arshad, along with six others. So of course, the Attorney General lost the case.

LoyarBurok 1 – 0 Attorney General’s Chambers of Malaysia

LoyarBurok | Edmund Bon was charged for driving under the influence of alcohol pursuant to section 45A(1) the Road Transport Act 1987 (RTA87). Amer Hamzah Arshad defended him and successfully persuaded the Magistrate. The AGC came close to proving a prima facie case against Edmund but eventually lost it. Sections 45A, 45B, and 45C of the RTA87 were considered at length.

Human rights march: 7 acquitted

Malaysiakini | The KL Sessions Court acquitted seven people, including lawyer Amer Hamzah Arshad, for participating in an alleged illegal human rights march two years ago, and for disobeying police orders to disperse. The judge stated that the oral permission granted by the police was consequentially sufficient to meet and satisfy the requirements of section 27(2) of the Police Act.

Edmund Bon and 4 other lawyers released on bail

Edmund Bon was released on RM1,000 bail while others, including Amer Hamzah Arshad, were released on RM2,000 bail.

Sivarasa, Eric Paulsen, and Amer Hamzah — and three others, after a failed attempt by the organisers of the Human Rights Day march to negotiate with the police to allow them to finish. The police also arrested Edmund Bon for preventing the authorities from performing their duty outside the Malaysian Bar building.

Walk for Justice: “When lawyers walk, something must be very wrong”

The Malaysian Bar | “Lawyers don’t walk everyday. Not even every month. But when they walk, then something must be very wrong,” said Chairman of the Bar Council Ambiga Sreenevasan when addressing a strong crowd of more than 2,000 members of the Malaysian Bar and some concerned citizens at the Palace of Justice before the commencement of the walk to the Prime Minister’s office to hand over the Bar’s memorandum urging the government to set up a Royal Commission of Inquiry to probe the state of judiciary and memorandum on the establishment of a judicial appointments and promotion commission.

By affirming the constitutionality of section 72 of the Danaharta act, which provides that the courts cannot give an order to restrain the powers or actions of Danaharta Urus Sdn Bhd, the Judiciary also affirmed its impotence. If the Judiciary is not willing to protect the people, who is left to save us?

Repeal S46A campaign not meant to challenge senior lawyers

Malaysiakini | Amer Hamzah Arshad, a Kuala Lumpur Bar Young Lawyers committee member, said the campaign to repeal section 46A of the Legal Profession Act 1976 is not an attempt by young lawyers to challenge their seniors. The campaign aimed to abolish the inequalities entrenched in the Act and allow lawyers the opportunity to decide who should lead the Bar.
