High Court: Immigration illegally detained three stateless children, Child Act also protects non-citizens

Malay Mail | In a groundbreaking ruling, the KL High Court decided that Malaysia’s Child Act 2001 also protects non-citizen children. A child has to be brought before a Court for Children within 24 hours of being arrested. Lawyer New Sin Yew lauded this judgment; a detention centre is no place for a child. He was assisted by Beatrice Chin, Allyna Ng, and Nur Izni Syazwani Ahmad.

MUDA Sec-Gen charged with failing to notify police about #ManaKapalLCS protest

New Straits Times | MUDA Sec-Gen Amir Hariri Abd Hadi was charged under section 9(1) of the Peaceful Assembly Act 2012, which carries a maximum RM10,000 fine upon conviction, for failing to notify the authorities before the #ManaKapalLCS protest. Lawyer Beatrice Chin Yuen Xin pleaded for a lower bail as this was Amir’s first offence and he had cooperated with the authorities throughout their investigation.

Malaysiakini | Counsel New Sin Yew confirmed that the KL High Court allowed a legal challenge against the EC’s decision to bar a quarantined voter from voting. Beatrice Chin also represented the applicant. Article 119 of the Federal Constitution, the Election Act 1958, and the Elections (Conduct of Elections) Regulations 1981 provide the right to vote; permission from the district health officer is not provided for.

Malay Mail | A Johor voter filed a suit against the government for preventing him from voting in the March Johor state elections. Beatrice Chin said that the EC should have taken proactive measures to conduct elections during the pandemic while ensuring that voters’ rights are not affected. Under election laws, the EC has no grounds to deny voters rights due to quarantine regulations.

He also agreed that the 18 Malaysian youths have been adversely affected by the respondents’ decision not to enforce the lower voting age by July 2021. New Sin Yew and Beatrice Chin, together with five other lawyers, represented the youths.
